Kimberley’s experience includes general dispute resolution and commercial litigation, acting for clients in:
- property litigation including seeking performance of property contracts and/or damages for a breach of property contract and leasing disputes;
- simple and complex debt recovery matters for individuals and large scale corporate clients;
- contractual, employment, warranty and franchising disputes;
- negligence claims against other professionals (including other legal practitioners).
She has provided a significant amount of advice to clients and insolvency practitioners in respect of personal properties and securities issues including:
- advising about whether security interests are perfected and enforceable
- assisting in the registration of securities on the personal properties securities register
- advising about terms and conditions of trade
- arranging for the removal of improperly registered security interests
Kimberley also has a particular interest in intellectual property law and has experience advising and acting for clients in relation to:
- the protection of business reputation (including advice and assessment on how business names and trademarks can be protected)
- the protection of an individual’s reputation (including claims for defamation)
- trade mark registrations, oppositions and disputes
- breaches of copyright and patent laws
- domain name disputes
