Ruby Nielsen is a Senior Associate within our dispute resolution team. Ruby holds a Bachelor of Laws and a Bachelor of Arts majoring in criminology and psychology from the University of Queensland.

Ruby has a particular interest in employment and industrial relations law, acting for employer and employee clients in unfair dismissal claims, general protections claims, redundancy and termination of employment disputes, breach of contract claims, post-employment restraint of trade claims, sexual harassment claims, discrimination claims and underpayment claims. She also advises employer and employee clients on the conduct of workplace investigations, performance management and misconduct issues, workplace bullying, privacy issues and industrial award interpretation. Ruby regularly assists clients with the preparation of employment agreements, independent contractor agreements, workplace policies and other HR documentation.

Ruby brings a detailed, commercial, and common sense approach to resolving disputes by providing realistic solutions to ensure the best possible outcomes for clients.

Experience

  • Acting for an employee in the stone benchtop industry in a general protections claim in the Federal Circuit and Family Court of Australia, resulting in the employee receiving a significant award of damages and the employer paying penalties and costs
  • Acting for a law firm pursing former partners of the firm for breaches of their restraint of trade clauses in the Supreme Court of Queensland
  • Acting for shareholders in a claim for oppression and breaches of directors’ duties in proceedings in the Supreme Court of Queensland
  • Acting for a private lender in recovering nearly $700,000 in proceedings in the District Court of Queensland
  • Acting for a client in complex proceedings in the District Cout of Queensland involving defamation, breaches of a business sale contract and contractor agreement, misleading and deceptive conduct and misuse of confidential information
  • Acting in disciplinary proceedings in the National Sports Tribunal
  • Acting in proceedings before the Fair Work Commission, Queensland Industrial Relations Commission and in the state and federal Human Rights Commissions in various claims including unfair dismissal and general protections claims, discrimination and sexual harassment claims and disputes about flexible work arrangements, including appearing at conciliation conferences, preparing evidence and submissions and appearing at hearings both with and without counsel
